OVERVIEW

Welcome to Maison Intemporelle. The terms “we,” “us,” and “our” refer to Maison Intemporelle. Maison Intemporelle operates this online store and website, including all related information, content, features, products, and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

By visiting our website, using our Services, or purchasing from Maison Intemporelle, you agree to these Terms of Service and the policies referenced herein. If you do not agree to these Terms, you should not use our Services.

SECTION 1 – PRODUCTS AND CONDITION

Maison Intemporelle specializes in vintage, antique, previously owned, and one-of-a-kind furniture, furnishings, artwork, decorative objects, and other home goods.

Because of the age and history of these pieces, they may exhibit wear, patina, variations, repairs, refinishing, fading, scratches, marks, discoloration, irregularities, or other evidence of age and previous use. Such characteristics are not necessarily defects and are often part of the character and history of vintage and antique pieces.

We make reasonable efforts to accurately photograph and describe each item, including known significant imperfections when identified. Photographs form an important part of each product description.

Colors and appearance may vary because of lighting, photography, computer monitors, mobile devices, and individual display settings.

Measurements are approximate unless specifically stated otherwise. Buyers are responsible for reviewing photographs, descriptions, measurements, and other listing information before purchasing and for asking any questions before completing a purchase.

SECTION 2 – ONE-OF-A-KIND INVENTORY AND AVAILABILITY

Many Maison Intemporelle items are one-of-a-kind and may also be offered for sale through other sales channels.

Although we make reasonable efforts to keep inventory information current, an item may occasionally sell elsewhere before our website inventory is updated. If an item is unavailable after an order is submitted, we may cancel the order and refund any amount paid for that item.

We reserve the right to correct errors in product descriptions, pricing, availability, or other information and to cancel an order when necessary because of such an error, subject to applicable law.

SECTION 3 – ORDERS AND PAYMENT

Submitting an order constitutes an offer to purchase the selected item or items. We reserve the right to accept or decline an order as permitted by law.

Customers agree to provide accurate and complete billing, payment, shipping, and contact information.

Applicable taxes and shipping or delivery charges, when any, may be added to the purchase price.

SECTION 4 – RETURNS, REFUNDS AND MATERIAL MISREPRESENTATION

Unless otherwise expressly stated in an individual listing, all sales are final.

Maison Intemporelle does not accept returns or exchanges or provide refunds for change of mind, fit, color, size, normal age-related wear, or other buyer preference.

We make reasonable efforts to accurately describe each piece and disclose known significant condition issues.

If you believe an item you received was materially misrepresented in its listing, please contact Maison Intemporelle promptly after receipt and provide photographs and a description of the issue. We will review the circumstances and, when appropriate, work with you toward a resolution.

Minor variations in color resulting from lighting, photography, or display settings, approximate measurements, and normal age-related wear that was visible or disclosed in the listing do not constitute material misrepresentation.

Nothing in these Terms limits rights or remedies that cannot legally be waived under applicable law.

SECTION 5 – LOCAL PICKUP

Local pickup may be available in the Madison/Sun Prairie, Wisconsin area.

Pickup arrangements will be coordinated after purchase. Customers should not arrive for pickup without a confirmed appointment.

Buyers are responsible for confirming before purchase that an item's dimensions are appropriate for their intended space and that the item can be moved through doorways, hallways, stairways, elevators, and other access points.

Unless otherwise agreed in writing, buyers are responsible for providing adequate assistance, equipment, and a suitable vehicle for transporting furniture purchased for local pickup.

SECTION 6 – LOCAL DELIVERY

Limited local delivery may be available for an additional charge depending upon the item and delivery location.

Customers interested in local delivery should contact Maison Intemporelle before purchasing when delivery arrangements or costs need to be confirmed.

Any delivery terms and charges agreed upon for a particular purchase will apply to that transaction.

SECTION 7 – NATIONWIDE FURNITURE SHIPPING

For furniture requiring freight, blanket-wrap, or specialty furniture transportation, shipping must be arranged and paid for by the buyer through a furniture carrier of the buyer's choice unless the individual product listing expressly states otherwise.

Shipping charges are not included in the purchase price unless specifically stated.

The buyer is responsible for selecting the carrier, arranging and paying for transportation, and obtaining any desired shipping insurance.

Maison Intemporelle will reasonably cooperate with the buyer and the buyer's selected carrier to coordinate pickup of the purchased item.

Once an item has been released to a carrier arranged by the buyer, responsibility for transportation, handling, loss, or damage occurring during transit rests with the buyer and carrier, subject to applicable law.

Furniture purchases requiring specialty transportation are handled through an inquiry process rather than standard online checkout. Buyers are encouraged to obtain transportation quotes and confirm their shipping arrangements before completing their purchase. Maison Intemporelle will provide the information reasonably needed to assist with obtaining shipping quotes.

SECTION 8 – SMALLER SHIPPABLE ITEMS

Smaller décor, artwork, accessories, and other items that can be shipped by standard parcel carrier may have shipping options and charges displayed at checkout or specified in the individual product listing.

Delivery dates and transit times provided by carriers are estimates and are not guaranteed by Maison Intemporelle.

SECTION 9 – THIRD-PARTY SERVICES AND LINKS

Our Services may contain links to, integrations with, or services provided by third parties.

Maison Intemporelle is not responsible for the content, policies, availability, performance, or practices of third-party websites or service providers.

Transactions or arrangements entered into directly between a customer and a third party, including buyer-selected furniture carriers, are subject to the terms established between those parties.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Maison Intemporelle is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly with Maison Intemporelle.

Shopify is not the seller of Maison Intemporelle products and is not responsible for the products sold by Maison Intemporelle except to the extent otherwise required by applicable law or Shopify's own terms.

SECTION 11 – INTELLECTUAL PROPERTY

The Maison Intemporelle name, branding, logos, website text, original photographs, graphics, designs, and other original content appearing through our Services are owned by Maison Intemporelle or used with permission and may be protected by applicable intellectual-property laws.

You may not reproduce, republish, distribute, modify, commercially exploit, or otherwise use Maison Intemporelle's protected content without prior permission except as permitted by law.

Third-party trademarks, names, photographs, artwork, and other intellectual property remain the property of their respective owners.

SECTION 12 – PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to violate applicable law; infringe intellectual-property or privacy rights; transmit malicious code; interfere with the security or operation of the website; obtain unauthorized access to systems or information; engage in fraud or misrepresentation; or otherwise misuse the Services.

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable law.

Because our store is hosted by Shopify, Shopify may also process personal information in connection with providing its services. Please review the Privacy Policy available through our website for additional information.

Information on our website may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, measurements, pricing, availability, shipping charges, or other information.

We reserve the right to correct errors or inaccuracies and update information as permitted by applicable law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT FOR REPRESENTATIONS EXPRESSLY MADE BY MAISON INTEMPORELLE.

WE DISCLAIM WARRANTIES THAT MAY LEGALLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

BECAUSE MANY PRODUCTS ARE VINTAGE, ANTIQUE, OR PREVIOUSLY OWNED, WE DO NOT WARRANT THAT THEY WILL BE FREE FROM AGE-RELATED WEAR OR IMPERFECTIONS.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

SECTION 16 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAISON INTEMPORELLE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICES OR PURCHASE OR USE OF PRODUCTS.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.

SECTION 17 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Maison Intemporelle and its service providers from third-party claims, losses, or liabilities arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another party's rights.

SECTION 18 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in effect.

SECTION 19 – WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms, together with the policies and other terms posted on our website that apply to a transaction, constitute the agreement between you and Maison Intemporelle concerning use of the Services and purchases made through the website.

SECTION 20 – GOVERNING LAW

These Terms and transactions with Maison Intemporelle shall be governed by applicable federal law and the laws of the State of Wisconsin, without limiting any consumer rights that cannot lawfully be waived.

SECTION 21 – CHANGES TO THESE TERMS

We may update these Terms from time to time. The current version will be posted on this website.

Changes will apply prospectively as permitted by applicable law.
